Terms of Service

Welcome to Neotopia. These Terms of Service ("Terms") govern your use of the Neotopia mobile application and web game (the "Service") operated by Media Phoenix Corp. ("Neotopia", "we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

You must be at least 13 years of age to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

You may create an account using email, Google Sign-In, Apple Sign-In, or as a guest. You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Providing accurate information during registration

Guest accounts have limited functionality and may be lost if the app is uninstalled. We strongly recommend linking your account to an email or social sign-in provider.

When using the Service, you agree not to:

• Harass, bully, threaten, or abuse other players
• Use hate speech, slurs, or discriminatory language
• Post sexually explicit, violent, or otherwise inappropriate content
• Impersonate other players, moderators, or staff
• Share personal information of others without their consent
• Spam, flood chat, or disrupt gameplay for others
• Advertise, solicit, or promote external services
• Exploit bugs, glitches, or vulnerabilities instead of reporting them
• Use unauthorized third-party software, bots, macros, or automation tools
• Attempt to access accounts, data, or systems that do not belong to you
• Engage in real-money trading of in-game items or accounts
• Create multiple accounts to evade bans or gain unfair advantages
• Reverse-engineer, decompile, or modify the Service or its code

You retain ownership of content you create (builds, messages, images, posts). However, by submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, display, modify, and distribute that content within the Service for operational purposes.

We may moderate, filter, or remove content that violates these Terms at our sole discretion. Automated profanity filters are applied to certain types of content. Repeated violations may result in account restrictions.

You are solely responsible for the content you create and share. Do not post content that infringes on intellectual property rights or violates any applicable laws.

Neotopia may offer optional experimental voice features that turn typed messages into speech using a voice created from a short sample you provide. By choosing to create a voice, you authorize Neotopia and its voice provider, EESI, to process that sample and generate speech for your in-game messages.

You may use only your own voice, or a voice you are legally authorized to use. You may not impersonate another person, mislead players about who is speaking, or use voice features to violate these Terms. Generated speech may be played to nearby players and remains subject to the same conduct and moderation rules as text chat.

Voice features are experimental and may be delayed, unavailable, or removed. You can turn voice messages off or delete your voice profile from the voice setup screen.

The Service may offer virtual currency ("Gems"), items, and other virtual goods. You understand and agree that:

• Virtual items and currency have no real-world monetary value and cannot be exchanged for real money
• Purchases of virtual currency are final and non-refundable except as required by applicable law or platform policies
• We reserve the right to modify, manage, regulate, or remove virtual items at any time
• Virtual items are licensed to you, not sold, and remain our property
• In the event the Service is discontinued, all virtual items and currency will be forfeited

In-app purchases are processed by third-party payment providers (Apple App Store, Google Play Store, or Stripe for web). All purchases are subject to the terms and refund policies of the respective payment provider. We do not store your payment information.

We reserve the right to take action against accounts that violate these Terms, including but not limited to:

• Warnings: Verbal or written warnings for minor violations
• Muting: Temporary restriction of chat privileges
• Cursing: Temporary restriction to specific worlds
• Banning: Temporary or permanent suspension of account access
• Content Removal: Deletion of offending user-generated content
• Inventory Adjustment: Removal of items obtained through exploits or violations

Enforcement decisions are at our sole discretion. Attempting to evade enforcement actions (e.g., creating new accounts after a ban) is itself a violation and may result in further action.

The Service, including its game design, artwork, code, audio, and text content, is owned by us and protected by intellectual property laws. You may not copy, distribute, modify, or create derivative works from the Service without our express written permission.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of virtual items, or loss of profits, arising out of or in connection with your use of the Service.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

You may delete your account at any time through the in-app Settings menu. Account deletion will permanently remove your personal data, gameplay progress, inventory, virtual currency, pets, friends list, and associated content. This action cannot be undone.

We reserve the right to delete inactive accounts after an extended period of inactivity, with reasonable notice where possible.

We reserve the right to modify, update, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

The Service may integrate with third-party services including Firebase, Apple, Google, Stripe, Sentry, Cloudflare, EESI, YouTube, and Twitch. User-selected YouTube and Twitch media remains hosted and delivered by those providers. Your use of third-party services is governed by their respective terms, and we are not responsible for their practices.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before pursuing formal legal proceedings.

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms with a new "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
